Are You An Equitable Caregiver?

In Georgia, it is possible for a third party to pursue custody rights for a child under the “equitable caregiver” law. The equitable caregiver law in Georgia was passed in 2019 and is relatively new. When dealing with it, you must have a skilled, experienced attorney on your side.

What Is Georgia’s Standard For Equitable Caregivers?

Despite the relative newness of the law, the courts have a firm test to determine if a caregiver should have rights. The law says to petition; you must have – among other points – “fully and completely undertaken a permanent, unequivocal, committed and responsible parental role in the child’s life.” The courts will look to ask these questions:

  • Will the child come to harm without the petitioner?
  • Has the child formed an emotional bond with the petitioner?
  • Is the petitioner able to meet the medical or psychological needs of the child?
  • Whether the parents or “competing parties” have an interest in building a relationship with the child?

Another factor to consider is that the petitioner largely must be seen as acting without any expectation of compensation down the road.
